    You mixed up the 88 hand, BU had actually over 120 bb. Still the point, you made in the hand is probably valid, that the bbs cold 4betting range is stronger than his shoving range and than the original open rasers range. I suppose you were 3bet calling the button, just because he had a good stack to 4bet light, are you calling the bbs shove? You are only 38 bb deep, so the bb might be shoving and pair and some broadways. There are def. some regs though, who exploit that read that a bunch of thinking players have, and 4bet exactly AQ or AK this way to get edditional fold equity, or even some bluffs. So against the trickiest opponents I would treat their 4bet range in this spot the same as their shoving range, with the added benefit that he could still fold, not getting close to 2:1.
